Supersonic Refer a Friend Campaign Terms and Conditions

Participation in the Supersonic Refer a Friend Campaign (“Refer a Friend Campaign”) organized by Supersonic Studios Ltd. (“Supersonic Studios” or “Supersonic”), is subject to the following terms:

Invite your game developer friends to join the Supersonic family and experience the benefits of our platform.

Submission: Any individual and/or entity (“Referring Studio”) may submit a game for review and consideration by Supersonic for future collaboration with Supersonic on growing their game (“Referred Studio”). The Referring Studio understands that a submission does not impose any obligation on Supersonic to review the game, nor to revert with any response. Once submitted, Supersonic may choose to contact the Referred Studio for further discussion regarding their game. In order to be eligible to participate in the Refer a Friend Campaign the Referred Studio (i) must not have any prior relationship or existing user account with Supersonic; (ii) must commence testing a hyper-casual game within two months after the studio’s creation. For the avoidance of doubt, you may not refer your own studio or game (including a game in which you are otherwise involved in its creation). Referred Studio whose email address you enter in the submission page will receive an invitation from Supersonic with a unique link to the Supersonic Refer a Friend Campaign page to apply and submit their games. Referred Studios applying via the unique link will allow Supersonic Studios to recognize your referral. Referring Studio and Referred Studio must each provide a separate bank account for the collection of the prize money (if and as applicable).

Incentives for the Referring Studio:

• 100k Incentive: The Referring Studio may be eligible to receive a one time prize of 100,000 USD for the first of Referred Studio’s hybrid games successfully published through Supersonic has turned a profit, as determined by Supersonic at its sole discretion.

• 20k Soft Launch Incentive: The Referring Studio may be eligible to receive a one time 20,000 USD prize for the first of Referred Studio’s games that completes a successful ‘soft launch’ as determined by Supersonic at its sole discretion.

• 5k MVP Test Incentive: The Referring Studio may be eligible to receive a one time 5,000 USD prize for the first of Referred Studio’s games that passes the MVP test with a score of at least 4+, after completing the full marketability funnel testing on platforms including Facebook, Google, Unity, and iOS (Facebook and Unity), as determined by Supersonic at its sole discretion.

Incentives for the Referred Studio:

• Payment per Prototype: Referred Studio may be eligible to receive a 400 USD prize for each of their first three games who have reached and completed Supersonic’s testing phase.

• Iteration Bonus: Referred Studio may be eligible to receive a one-time iteration bonus of 5,000 USD for one of the first 3 games who have successfully completed iteration, as determined by Supersonic at its sole discretion.

In no event will Supersonic Studios be liable for any loss or damages whatsoever including, but not limited to, direct, indirect, special, incidental, punitive, exemplary, or consequential damages of any kind, or for personal injury, resulting from or arising out of your participation in the Supersonic Refer a Friend Campaign and/or receipt of the prizes (if any).

Confidentiality. All information relating to the Supersonic Refer a Friend Campaign, and all other confidential or proprietary knowledge, data, information, or material furnished to you or to which you are exposed as a result thereof, constitute Supersonic Studios’ confidential information. You agree to hold such information in strict confidence, not publish, disclose, or otherwise make it available to others, and not use it except for performance of these terms.

Law. These terms are governed by the laws of Israel, excluding its conflict of law rules, and you hereby agree to submit to the personal and exclusive jurisdiction of the courts located in Tel Aviv, Israel.

General. These terms supersede all prior agreements signed between you and Supersonic Studios related to the subject matter hereof. If a section hereof is held invalid or unenforceable by a competent court, it will not affect the validity of the other sections and will be substituted with a valid and enforceable one which most closely approximates the original section. Only one Referring Studio can receive the referral reward for the Referred Studio. Therefore, only the first referrer of such Referred Studio can become entitled to the referral reward amount, payable in one payment.

A Referred Studio is only valid if the Referred Studio details can be verified by Supersonic.

If you become eligible for payment of the prizes, Supersonic will contact you using your contact details provided above.

You hereby undertake, represent and warrant that you are not located in and/or operating in a country designated by the United States Department of the Treasury’s Office of Foreign Assets Control (OFAC) or a person on the Specially Designated Nationals List ( SDN).

We may disqualify you from receiving a referral reward (or take any other action necessary to protect our rights) if we discover that your referral has committed any fraud (for example, if the Referred Studio and you have the same email or similar information).

We reserve the right to change the terms of the referral program at any time and for any reason (or no reason). Supersonic reserves the right to interpret and apply the terms and conditions of this contest at its sole discretion. Supersonic also reserves the right to modify, suspend, or terminate the program at any time without prior notice and without liability.
